His mental capacity may not be adequate to make this decision without assistance (Nursing World, 2010). The brother needs to consider the fact that the patient had the Advance Directive before he became ill, and consider his ability to make decisions at the time he signed the advance directive (Nursing World, 2010). There were several HIPAA violations noted in this scenario. The physician spoke to the niece about the condition of the patient without consent of the power of attorney or the patient (Sheahan, 2011).
